Please show me a prior court case where this has happend? 

Even if it has I wouldnt want to fight like this. Patent law is not a
bad thing. If I develop something at my own cost/time and it is adopted
by everyone on the planet and becomes "industry standard" I am still
due my fair share until the patent runs out.
