... and it still have the Vista-notepad icon copyrighted by Microsoft.

If you have no Vista, you can google for "Vista icons" under "pictures" , 
then you find it.

It is ok,. if you use code and/or icons from other OpenSource-projects.
But if you hear, that there is something not legal, then I think, you have 
to delete the illigal parts (code or icons) so fast as possible.
But I believe, that there comes the time, where your audit

wil be ended and the Microsofts notepad icon is still part of ReactOS.
