if judge rules that apis can be copyrighted then windows apis will autmaticly fall under us copyright law (im guessing judge is leaning that direction)

now truble is if such apis fall under copyright reactos by its vary nature violates copyright law and so does wine on linux etc

maybe maybe not but im sure several reactos developers in the usa do and theyed have to worry about it regardless

If this goes badly, it will affect a *LOT* of software projects both open and closed source.

Keep in mind Microsoft largely got to where it is by copying APIs from things like CP/M, Classic MacOS, and Java.

So, in other words, ReactOS doesn't really need to worry about it too much as there WILL be other larger players contesting this if it goes through. Possibly even Microsoft.

orignaly microsoft didnt file software patents till they got there but burned by them so dont be so sure

A defeat for Google would screw US based users and maybe US based contributors. It would have almost no relevance for foreign based contributors and users due to differing law, and the ruling by the European Court of Justice pretty much torpedoes any law that attempts to impose the notion of API copyrights in the EU, regardless of any treaty the US may attempt to force. There is also this little provision the EU court handed down where it basically stated in any instance where there is the possibility of joint US/EU jurisdiction on a matter, the European court's ruling takes precedence over the entire issue. But a defeat for Google WILL be appealed, because of how badly every software development company (hell, every company that has an IT department for that matter) in the US would get fucked one way or another. Too much software has been built on the notion that APIs are not copyrightable that there would not be a single piece of uninfringing code. Whether the US Supreme Court is competent enough to understand just how ludicrous the notion of API copyrights are is another matter entirely.

what percentage of reactos devlopers are inside the usa what percentage are inside europe etc i suspect that given how hard it is to develop reactos that it will be loads harder losing such devlopers even if only a small number

I read the article linked at the top. Google didn't copy anything - only made its own code that works the same way. If that's a copyright violation, then every vehicle on the road today that isn't made by the first car company (whatever that was) is also a copyright violation. Here's hoping the judge will see it that way. He won't decide that part until the end of the trial.

The thing here is that Google didn't rewrite or reimplement anything. They cloned the JavaSDK bit for bit. The Android implementation even shares the same checksum for a number of files. Personally I fully believe they knew what they where doing. And I hope that their stupidity doesn't destroy the entire core of open-source development from a legal perspective.

This would contradict the spirit of previous rulings it seems, since "look and feel" is not protected, and clean room engineering is legal. I just hope it gets thrown out. Patent seems the bigger issue here, unless the judge sets a bad precedent in the copyright issues.

if the US closes reactos.org then reactos can move the project to a none us domain or to SourceForge and if the us government tride to get SourceForge to remove projects that will be political suicide a lot of BIG companies support SourceForge
